Waiver of Liability, Assumption of Risks, and Indemnity Agreement
Waiver of Liability: In consideration of permission to use, today and on all future dates, the property,
facilities, and/or equipment of Our Lady of Peace Gyms located at 10526 Grandview Road, Kansas City,
MO 64137 (the “Property”), I, for myself, and my minor child/ward identified herein as Participant, and all
other minor children/wards of mine who may be a participant or spectator and for our respective heirs,
personal representatives or assigns, do hereby release, waive, and discharge KC Nets, David B. Wentz
and family, and Our Lady of Peace, and their heirs, personal representatives, assigns, employees,
agents, and insurance companies (“Released Parties”), from liability from any and all claims including
the negligence of Released Parties or any of them resulting in personal injury, accidents, or illnesses
(including death), and/or property loss arising from, but not limited to, participation in activities at and/or
using the property.
Assumption of Risks: Physical activity, by its very nature, carries with it certain inherent risks that cannot
be eliminated regardless of the care taken to avoid injuries. I know, understand, and appreciate these
and other risks that are inherent in the activities that may take place at or while using the Property. I
hereby assert that my participation and the participation of the Participant are voluntary and that I
knowingly assume all such risks on my behalf and on the behalf of the Participant and any other minor
child or ward of mine while at and/or using the Property.
Indemnification and Hold Harmless: I also agree to INDEMNIFY AND HOLD the Released Parties
HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and
liabilities, including attorney’s fees brought as a result of my participation or the participation of
Participant or of any other minor child or ward of mine in activities at and/or while using the Property.
Severability: The undersigned further expressly agrees that the foregoing waiver of liability, assumption
of risks, and indemnification and hold harmless agreement is intended to be as broad and inclusive as
is permitted by the law of the State of Missouri, and that if any portion thereof is held invalid, it is agreed
that the balance shall, notwithstanding, continue in full legal force and effect.
Acknowledgment of Understanding: I have read this waiver of liability, assumption of risks, and
indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights,
for myself and my minor children and/or wards, including my right and the rights of my minor children or
wards to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my
signature to be a complete and unconditional release of all liability and assumption of risks, and an
affirmative agreement of indemnification and hold harmless to the greatest extent allowed by law. I
further represent and warrant that I have the authority to execute this Agreement on behalf of myself, the
Participant and my other minor children and/or wards.
